Refund policy


1. Preliminary Information

All details in this document are governed by Romanian law.

2. Return of products

If you are dissatisfied with the products purchased from nidussolaris.com and wish to cancel the purchase and receive your money back, you can apply for the product return procedure within 14 calendar days, according to the provisions of Emergency Ordinance no. 34/2014, regarding consumer rights in contracts concluded with professionals, as well as for the amendment and completion of certain normative acts.

A distance contract is understood as a contract for the supply of products or services concluded between a trader and a consumer, within a sales system organised by the trader, which exclusively uses, before and upon the conclusion of this contract, one or more distance communication techniques.

The right of return within 14 calendar days is only addressed to buyers who have purchased products online from the website www.nidussolaris.com

The customer has the right to unilaterally terminate the distance contract, within 14 calendar days, without penalties and without invoking any reason.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract, using an unequivocal statement, for example, a letter sent by post or e-mail.

For this purpose, you can use the withdrawal model here; its use is not mandatory, however.

You can also send an e-mail to contact@nidussolaris.ro or any other unequivocal statement, with all the information in the form mentioned above. If you use this option, we will send you without delay, on a durable medium, for example by e-mail, confirmation of receipt of the withdrawal request.

We may postpone the reimbursement until we receive the products back or until you have provided us with proof that you have sent the products back, whichever is the earliest.

The 14 calendar day period for exercising this right shall take effect:

a) on the day on which the consumer or a third party other than the carrier and indicated by the consumer acquires physical possession of the products, in the case of sales contracts, or:

(i) if the consumer orders multiple products to be delivered separately in a single order, the day on which the consumer or a third party other than the carrier and indicated by the consumer acquires physical possession of the last product;

(ii) in the case of delivery of a product consisting of several lots or pieces, the day on which the consumer or a third party other than the carrier and indicated by the consumer acquires physical possession of the last product or piece;

3. Excluded products, without right of return

products whose price depends on fluctuations in the financial market that the professional cannot control and which may occur during the withdrawal period;

products made according to the specifications presented by the consumer or clearly personalised

products that are susceptible to rapid deterioration. These exceptions apply according to Art. 16 of OUG 34/2014 and are not limited to this section.

4. Omission of information on the right of withdrawal

If nidussolaris.com has not sent the consumer information on the right of withdrawal according to the provisions of OUG 34/2014, the withdrawal period expires 12 months from the end of the initial withdrawal period of 14 calendar days.

If nidussolaris.com has sent the consumer the information regarding the right of withdrawal within 12 months from the date on which the products/services are deemed to have been delivered, as mentioned in the section above, the withdrawal period expires within 14 calendar days from the date on which the consumer receives that information.

5. Obligations of nidussolaris.com in the event of withdrawal

nidussolaris.com shall reimburse all amounts received from the consumer, including, where applicable, the costs of delivery if these have been paid by the consumer, without undue delay and, in any event, not later than 14 calendar days from the date on which it is informed of the consumer's decision to withdraw from the contract in accordance with the provisions of the law.

nidussolaris.com refunds the amounts mentioned above using the same payment methods as those used by the consumer for the initial transaction, unless the consumer has agreed to another payment method and provided that the consumer is not responsible for paying commissions following the refund, as follows:

If the payment was made by bank transfer/payment order, the refund of the amount will be made by bank transfer to the account indicated by the buyer. Additional costs regarding bank commissions will be borne by the buyer.

If the payment was made by cash on delivery, the refund will be made either by bank transfer to the account indicated by the buyer (additional costs regarding bank commissions being borne by the buyer).

If the payment was made by card, the refund of the amount will be made on the same card used for the purchase, within 14 days of accepting the return, in which case no additional commission will be charged.

Without prejudice to the first paragraph of this section, nidussolaris.com is not obliged to reimburse the additional costs if the consumer has explicitly chosen a type of delivery other than the standard delivery offered by nidussolaris.com

Except where nidussolaris.com has offered to collect the products itself, in the case of sales contracts, nidussolaris.com may postpone the reimbursement until the date of receipt of the products that were the subject of the sale or until the moment of receipt of proof from the consumer that he has sent the products to nidussolaris.com, whichever is the earliest.

Professionals (any natural or legal person, public or private, acting within the framework of their commercial, industrial or production, artisanal or liberal activity in connection with contracts falling under the incidence of OUG no. 34/2014, as well as any person acting for the same purpose, in their name or on their behalf: companies, foundations, associations, cooperatives, professional organisational forms, individual or group practices, institutions, any entity that is not a consumer according to art. 2 of Law no. 449/2003 on the sale of products and guarantees) associated with them do not benefit from the right of return within 14 days.

6. Transaction cancellation

The card transaction can be cancelled until the order is confirmed, in which case the issuing bank will release the blocked amount in the customer's account within 1-30 days, depending on its policy.

7. Consumer obligations in case of withdrawal

According to Ordinance no. 34/2014, the consumer only bears the direct costs related to the return of the products, unless nidussolaris.com expressly agrees to bear those costs or nidussolaris.com has not informed the consumer that these costs must be borne by the consumer. In the case of off-premises contracts, where the products have been delivered to the consumer's home at the time of conclusion of the contract, nidussolaris.com takes over the products at its expense if the products, by their nature, cannot be returned normally by post. In any situation of returning products, they must be in the same condition in which they were sent to the Customer, in the original packaging, with intact labels and together with all accompanying documents (invoice, warranty certificate, etc.). The returned products must be in the same condition as upon receipt: without defects (except for hidden defects and except for defects already reported by the Customer in correspondence with SC Nidus Solaris SRL).
